1. Terms & Conditions of Membership

1.1 The following terms and conditions apply to Social Fitness members who elect to pay their membership fees in monthly instalments or via up front payments.

2. Limitation of Liability

2.1 The member acknowledges that Social Fitness obligations and liabilities in respect of Social Fitness are defined in this agreement.


2.2 The member is responsible for the consequences of any use of any of the facilities and equipment at Social Fitness classes or personal training sessions. Social Fitness will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.

3. Physical Health of Member

3.1 A member engaging in Social Fitness activities are responsible for ensuring that they are properly equipped and that their state of health and physical condition are such as not to involve any risk to themselves or any other person taking part. It is hereby understood and agreed that Social Fitness accepts no responsibility for accident, injury, illness, loss or misadventure caused to or suffered by members whilst participating in Social Fitness classes or personal training sessions.


3.2 The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition. 


3.3 Before attending Social Fitness classes, the member must first complete a Social Fitness questionnaire to assess their health and well being. Social Fitness must be notified immediately if there are any changes to a member’s mental or physical well being.

4. Memberships

4.1 The categories of membership are month to month, 3 month, and 6 months minimum periods, personal training or pay as you go packages which must be used within their stated expiry date. All categories shall be subject to these Terms and Conditions of Membership, which are in force at the time.

4.2 Other categories of membership shall be stipulated by Social Fitness from time to time.

5. Membership Charges & Payment Options

5.1 Members are liable to pay all agreed monthly membership fees irrespective of actual usage of Social Fitness classes. There is a no refund policy for non-usage of Social Fitness memberships. If you are seriously ill, injured or fall pregnant and can provide a doctor's letter we will use our discretion to refund your membership.


5.2 Members elect to pay their membership fees on recurring monthly basis through Direct Debit on the 1st of the month.


5.3 Payments for pay as you go packages and personal training packages are via up front payments only.


5.4 Social Fitness reserves the right to increase Membership fees when deemed necessary.

5.5 All late payments will incur a £5 charge per day.

6. Membership Termination

6.1 A member whose membership is terminated by Social Fitness shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their membership fee.

7. Expulsion of Members or Termination of Membership

7.1 Social Fitness may expel members or may terminate the membership of any member:
   

7.1.1 without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of Social Fitness, it may be injurious to the character, name or interests of Social Fitness or is such that it renders the member unfit to associate with other members of Social Fitness.


7.1.2 If any part of the membership charge which is due and payable remains unpaid 30 days after the due date for payment.

8. Facilities and Equipment

8.1 Social Fitness reserves the right to make reasonable alterations to the type of facilities provided without notice and Social Fitness shall not be liable for any inconvenience caused by building works, road works and for the provision of essential maintenance services that occur for 14 days or less, due to matters beyond our control or improvement works.

9. Planned Classes

9.1 On very rare occasions an instructor may be ill or unable to attend a class, Social Fitness will try our very best to find a suitable replacement as soon as possible to ensure the planned class goes ahead. If a suitable instructor cannot be found in time for the class, the class will be cancelled. Social Fitness shall endeavour to give members reasonable notice of cancellation. No refund or compensation will be awarded unless otherwise agreed.


9.2. Due to extreme weather conditions and health and safety, on very rare occasions the class may be cancelled. Social Fitness shall endeavour to give members reasonable notice of cancellation. No refund or compensation will be awarded unless otherwise agreed.


9.3 Information in relation to Social Fitness classes timetable is available on the website. All updates, session time amendments and further information will be available on the Social Fitness website and social media sites. We recommend you view the website on a regular basis or follow our social media to keep yourself updated.


9.4 Monthly Members can attend any session at any location without prior booking, please view website for up to date locations, days, times, amendments etc.


9.5 Social Fitness will be closed for a short period at Christmas and some public holidays. Please see the updates via our website or view our Social Fitness social media pages.

10. Cancellation Policy

10.1 48 hours notice of cancellation is required for all for Personal Training sessions. Notice of less than 48 hours notice will incur full payment of the session fee.


10.2 If you are more than 20 minutes late for your for Personal Training session, the time will not be extended and will end at the appointed time or may be cancelled and you will incur full payment of the session fee.


10.3 Monthly membership cancellation must be requested 30 days in advance of the next billing date. 3 and 6 month contracts can only be cancelled after the contract end date.
